THE LEGAL REGULATION OF ELECTRONIC DIVORCE

Abstract
This study examines e-divorce as a manifestation of the digital transformation in family relationships by defining the concept and distinguishing it from traditional divorce, and by analysing the position of the UAE legislature on the matter in light of the Personal Status Law. It also addresses the legal issues associated with proving it by examining traditional and modern means of proof, such as acknowledgment, testimony, records, and electronic signatures, as well as the decisive oath. The study concludes that the validity of e-divorce is contingent upon the proof of intent and the validity of its attribution, alongside the need for legal safeguards that keep pace with technological advancements and ensure the protection of family stability.
