<strong>Abstract</strong><br>

Section 171 of CRPC mandates submission of bond for appearance to the complainant and the witnesses and provides for penal consequences in cases of non-submission of bond. This paper contemplates the constitutionality of sections 170(3) and 171 of CRPC in the light of interpretation by the Hon'ble Supreme Court of right to fair trial as a part of article 21 of the Constitution of India.
