Reformative Theory: The Application, Challenges and Possibilities for the Treatment of Prisoners from an Indian Perspective

Abstract
With the changing values of modern society, penologists' approaches toward punishment have shifted from retribution to reformation. Along with the other parts of the world, efforts have been made in the Indian prison administration by introducing various measures to treat prisoners with a reformative approach, such as probation, parole, furlough, open-air prisons, aftercare, etc. To a certain extent, the judiciary has given directives on a reformative approach. Towards prisoners' reformation, a few individual contributions were worth mentioning. Yet as far as legislation is concerned, India has not incorporated modern philosophy into prison central law for uniform application. In the efforts made by the Government, judiciary and individuals, this paper will present the challenges faced and possibilities for reform.
